REGULATIONS OF THE ONLINE STORE

§1

General provisions

1 The online store conducts retail sales via the Internet, based on these Regulations.

2 The owner of the Store is: Fisharrow S p. of o.o. Krakow, ul. GEN. JAKUBA JASINSKIEGO No. 5 , NIP: 6793194811, tel. +48502514023, email address: info@fisharrow.com .

(3) The Regulations are an integral part of the sales contract concluded with the customer.

(4) The condition for the conclusion of a sales contract is the acceptance of the Regulations by the Customer.

(5) Prices quoted in the Store are gross prices (including VAT).

6 Goods available in the Store are free from physical and legal defects.

§2

Orders

(1) Orders can be placed as follows:

  • via the form available on the Store’s website,

(2) As a condition for the execution of the order, the customer must provide data that allows verification of the customer and the recipient of the goods. The store confirms receipt of the order by email or telephone. The store has the right to refuse an order, limit the method of payment or demand prepayment if the order raises reasonable doubts about the veracity and reliability of the data provided or the method of payment.

(3) The parties are bound by the information contained on the Store’s website next to the purchased goods at the time of ordering, in particular: the price, the characteristics of the goods, their features, the elements included in the set, the date and method of delivery.

(4) The information on the Store’s website does not constitute an offer within the meaning of the Civil Code. When placing an order, the customer makes an offer to purchase specific goods. The contract of sale is concluded when the Customer confirms the Order by clicking on the confirmation link in the email sent to the Customer by the Store.

§3

Payments

(1) The customer has a choice of payment methods specified in the Forms of payment tab.

(2) Shipping prices are specified in the delivery price list.

(3) The condition for the release of goods is payment for the goods and shipment.

(4) Settlement of credit card and e-transfer transactions is carried out through Dotpay.co.uk.

§4

Shipment of goods

(1) The ordered goods are shipped by the Store via shipping companies (such as the Polish Post Office or a courier service).

(2) The maximum delivery time for orders with delivery in the territory of the Republic of Poland is five working days. The maximum delivery time for orders with delivery outside the Republic of Poland is ten working days.

(3) In the case of payment by payment card, the order processing time is calculated from the moment of positive authorization of the transaction.

(4) In the case of payment by means other than cash on delivery, the shipping date is extended by the period between the placement of the order and the date of crediting the amount due to the Store’s bank account.

§5

Complaints

(1) In the case of non-conformity of goods with the contract, the Customer should send back to the Store, at the expense of the Store, the advertised goods with a description of the non-conformity.

(2) The store shall respond to the customer’s complaint within 14 working days after returning the goods with a description of the discrepancy.

(3) When the realization of a legitimate complaint involves sending the customer new goods or removal of discrepancies, the cost of delivery shall be borne by the Store.

(4) Individual settings of the Client’s computer and monitor that cause erroneous or distorted display of information about goods (such as colors), can not be the basis for a complaint.

§6

Right to withdraw from the contract

(1) Pursuant to the Law on Consumer Rights of May 30, 2014. The customer has the right to withdraw from the contract.

(2) The right to withdraw from the contract is effective if the Customer submits to the Store, within 14 days of receipt of the goods, a statement of withdrawal from the contract.

(3) The customer shall return the goods to the Store within 14 days of the declaration of withdrawal from the contract.

(4) Within 3 working days after receiving the shipment, the Store will check the condition of the transferred product.

(5) Within 7 days of inspection of the goods, the Store shall return the amount paid to the Customer. The customer should indicate the bank account number to which the refunded amount is to be transferred. In the case of payment by credit card, the refund will be made to the card.

(6) The right of withdrawal shall not be granted to the customer in the cases specified in the law referred to in paragraph. 1 above.

§7

Privacy protection

(1) By placing an order, the customer agrees to the processing of his personal data for the sole purpose of processing the order.

(2) The customer may also give separate consent to receive advertising and promotional materials from the Store, including a trade newsletter.

(3) The customer has the right to access and correct his personal data, to request the cessation of its processing and to object to its processing,

Intellectual property

It is forbidden to use any materials published on the Store’s website (including photos and descriptions of goods) without the Store’s written consent.

§9

Entry into force and changes to the Regulations

(1) The Regulations shall come into force as of the date of publication on the Store’s website.

(2) These Regulations may be amended.

(3) Changes to the Terms and Conditions will be published on the Store’s website.

(4) Information on changes to the Terms and Conditions will be sent to the Customer at the email address indicated in the order.

(5) Amendments to the Regulations shall become effective 14 days after their publication in the manner specified in paragraph (5). 3.

(6) The store recognizes that the customer has accepted the changes to the terms and conditions, if the customer has not terminated the contract by the end of the period indicated in paragraph. 5.
